Article 1 – Definitions

The following definitions apply to these Terms and Conditions.

Cooling-off Period: The period during which the consumer can exercise their right of withdrawal.

Consumer: The natural person acting for purposes outside their trade, business, craft, or profession who enters into a distance contract with the entrepreneur.

Continuous Transaction: A distance contract relating to a series of products and/or services where delivery and/or purchase obligations occur over time.

Durable Medium: Any tool that allows the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

Right of Withdrawal: The consumer’s right to cancel the distance contract within the cooling-off period.

Entrepreneur: The legal entity offering goods and/or services to consumers through an online store.

Distance Contract: An agreement concluded via an organised system for distance selling where only distance communication techniques are used up to and including the conclusion of the agreement.

Distance Communication Technique: Means used to conclude a contract without the consumer and entrepreneur being physically present in the same location.

Terms and Conditions: These general terms and conditions of the entrepreneur.

Article 3 – Applicability

These Terms and Conditions apply to all offers made by Votole and to all agreements concluded between the entrepreneur and the consumer through the website.

Before the distance contract is concluded, these Terms and Conditions will be made available to the consumer through www.votole.com If this is not reasonably possible, the consumer will be informed where the Terms and Conditions can be reviewed and that they will be provided free of charge upon request.

If the agreement is concluded electronically, these Terms and Conditions may also be provided electronically in a way that allows the consumer to store them on a durable medium.

If additional product-specific conditions apply, these will apply alongside these Terms and Conditions. In the event of conflicting provisions, the consumer may always rely on the provision that is most favourable.

If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions remain in full force and effect.

Situations not covered by these Terms and Conditions will be interpreted in the spirit of these Terms and Conditions.

Article 4 – The Offer

If an offer has a limited validity period or is subject to specific conditions, this will be clearly stated.

All offers made by Votole are non-binding. We reserve the right to modify or adjust offers when necessary.

The offer contains a clear description of the products offered so that the consumer can properly assess the offer. Product images are intended to represent the products as accurately as possible. Minor differences in colour or appearance may occur due to screen settings.

Obvious mistakes or errors in pricing or product information do not bind Votole.

Each offer contains sufficient information for the consumer to understand the rights and obligations associated with accepting the offer.

This includes the total price including VAT, the available payment methods, delivery conditions, the right of withdrawal, the steps required to conclude the agreement and the languages in which the agreement can be concluded.

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer and meets the conditions specified.

If the consumer accepts the offer electronically, Votole will confirm receipt of the order electronically without delay.

Votole takes appropriate technical and organisational measures to ensure secure electronic payment and data transmission.

Votole reserves the right to refuse or cancel orders when there is reasonable suspicion of fraud, incorrect information, or payment issues.

All agreements are concluded subject to product availability.

Article 6 – Right of Withdrawal

When purchasing products, the consumer has the right to cancel the agreement within 30 days without providing a reason.

The cooling-off period begins on the day after the consumer receives the product.

During this period, the consumer should handle the product with care and only unpack or use it to the extent necessary to determine whether they wish to keep the item.

If the consumer wishes to exercise the right of withdrawal, they must notify Votole within 30 days via info@votole.com.

After notification, the consumer must return the product within 30 days.

Proof of return shipment may be requested.

If the consumer fails to notify Votole or return the product within the stated timeframes, the purchase will be considered final.

Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, the cost of returning the goods will be borne by the consumer.

Once the returned product has been received and inspected, Votole will process the refund within 14 days, provided that the returned item meets the return conditions.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for certain products where clearly stated before purchase.

This may apply to products made according to the consumer’s specifications, clearly personalised products, products that cannot be returned for hygiene reasons, or products that deteriorate quickly or have a limited shelf life.

Article 9 – The Price

During the validity period stated in the offer, product prices will not be increased except in the case of changes in VAT rates or legal requirements.

Prices listed on the website include VAT unless stated otherwise.

Article 10 – Conformity and Warranty

Votole ensures that products comply with the agreement, the specifications stated in the offer, and reasonable standards of quality and usability.

Any additional warranties provided by manufacturers or suppliers do not affect the legal rights of the consumer.

Article 11 – Delivery and Execution

Votole will take the greatest care in processing and fulfilling orders.

Orders are delivered to the address provided by the consumer during checkout.

Orders are typically processed within 1–4 business days. Delivery times may vary depending on the destination.

If delivery is delayed or cannot be completed, the consumer will be informed as soon as possible.

If an order cannot be fulfilled, the consumer will receive a full refund.

Article 12 – Payment

Payment must be made using one of the available payment methods provided during checkout.

Consumers are responsible for ensuring that their payment information is accurate.

If payment cannot be completed or is declined, the order may be cancelled.

Article 13 – Complaints Procedure

Votole has a complaints procedure and will handle complaints accordingly.

Complaints regarding the performance of the agreement must be submitted clearly and in full to info@votole.com.

We aim to respond to complaints within 14 days of receipt.

Article 14 – Disputes

These Terms and Conditions are governed by the laws of the United Kingdom.

Any disputes arising from agreements between Votole and the consumer will be submitted to the competent court in the United Kingdom.

Article 15 – Additional or Different Terms

Any additional terms that differ from these Terms and Conditions must not be to the disadvantage of the consumer and must be recorded in writing or in a way that allows the consumer to store them on a durable medium.
